Texas Courts Have Held Landlords Liability for Third-Party Crimes

The following five factors are elemental in determining whether an injury-producing crime was foreseeable:

  • Frequency: If crimes often occur near the property during any given period, courts may consider this as proof that the third-party crime that injured the plaintiff was foreseeable.
  • Proximity: A property owner may be liable for the injuries resulting from a third-party criminal act if other similar crimes often occurred within the vicinity of the defendant’s property.
  • Publicity: Texas courts will consider how notorious the area of the defendant’s property is for similar crimes when determining the foreseeability of the crime that caused the plaintiff’s injury.
  • Recency: An important factor in deciding how foreseeability the crime in question was, a court will consider how recent other similar crimes occurred before the crime that injured the plaintiff occurred.
  • Similarity: Courts will evaluate the nature of other crimes and assess how similar those crimes were to the crime that injured the plaintiff.

For example, an apartment owner may be liable for injuries someone sustained during an armed robbery if the area was a known hot-spot for robberies. However, an apartment owner probably is not liable for injuries resulting from a sexual assault committed by the plaintiff’s spouse.
