The Texas A&M Transportation Institute released a study in 2013 that ranked Houston as having the sixth-highest rate of traffic congestion in the nation. The average Houstonian spends approximately two full days per year sitting in traffic, a circumstance that drives many to feel frustrated and irritable. To make matters worse, Houston has some of the worst drivers in the country: According to Allstate Insurance's 2012 Best Drivers Report, drivers in Houston are 25.9 percent more likely to be involved in car accidents than the national average. The unfortunate result is numerous preventable accidents caused by aggressive (and often illegal) driving behaviors.

What is Aggressive Driving?

Put simply, aggressive driving is any type of behavior made by a driver that increases the risk of a traffic accident. Aggressive driving typically involves multiple unsafe maneuvers or traffic infractions and plays a role in a large percentage of all accidents throughout the state. The Texas Department of Transportation reports that more than a quarter of all crashes involve speeding. Another 14 percent occurred when drivers ran red lights or stop signs, and 12 percent involved unsafe turns or failure to yield right of way while turning. In addition to incidents in which aggressive driving was a factor, 959 accidents were directly attributed to road rage on the part of one of the drivers. Aggressive driving takes many forms, all of which are entirely unacceptable.

Examples of aggressive driving include:

  • Speeding
  • Unsafe lane changing
  • Unsafe passing or passing on the wrong side
  • Cutting off other drivers
  • Tailgating
  • Jackrabbit starts from intersections
  • Denying the right of way at a turn or stop sign

Motorists who commit moving offenses can face fines of up to $200, potential jail sentences, and other negative repercussions to their driver's license. Unfortunately, law enforcement officers are not always able to stop an aggressive driver before they cause an accident.

Pursuing Compensation as a Victim of Road Rage

Although aggressive motorists can be held criminally accountable after an accident, this does nothing to reimburse victims of their negligence. Accident victims, therefore, have the right to hold the at-fault driver civilly liable for damages through an injury claim or lawsuit. The financial recovery can be used to pay medical bills, reimburse lost wages, and compensate for pain and suffering. It is important to involve a qualified and reputable attorney as soon as possible to ensure that you have the best chance of receiving compensation.
