The Daspit Law Firm Files Lawsuit on Behalf of Woman Injured in Trip and Fall Accident

On September 15, 2015, Dawn Campbell filed a lawsuit against Walgreens Specialty for an alleged accident that occurred due to unsafe floor conditions in a Port Arthur Walgreens pharmacy. The lawsuit has been filed in the Jefferson County District Court, and Houston personal injury attorneys John Daspit and Robert Morse of The Daspit Law Firm are representing the client.

The accident occurred when Ms. Campbell was walking through an aisle where she tripped on an empty spray pallet lying across the floor. Due to the incident, Ms. Campbell allegedly sustained head, neck, back, and leg injuries. Additionally, the woman claims she has suffered physical impairment and disfigurement, pain, suffering, and emotional distresses. Currently, she has incurred medical expenses.

Walgreens may be held accountable for its alleged failure to maintain reasonably safe conditions on the premises and for failing to inform customers of the hazardous condition. Our firm hopes to obtain the financial compensation our client will need to cover her expenses and damages resulting from the accident.

The Responsibilities of Property Owners

It is the duty of property owners to maintain reasonably safe conditions on their premises to prevent other persons from becoming injured. Property owners can be held responsible for a guest’s harm in the following situations:

  • There existed a unreasonable danger for injury on the premises
  • The owner was aware or should have been aware of the danger
  • The property owner breached their duty of regular care and maintenance to guard visitors from harm by failing to provide guests with warnings or signs of hazardous conditions
  • The property owner did not make conditions and equipment reasonably safe
  • The breach caused injury to a guest
